Terms of Service

1. Platform Description
AkShoot.ly (“the Platform”) is a photo gallery and directory service for climbing event photography in the Philippines. The Platform allows photographers to upload, tag, and display event photos, and allows climbers and the public to search for and download watermarked versions of those photos.
The Platform is not a marketplace, payment processor, or intermediary. It does not facilitate, process, or take commission on any financial transactions between users.
2. User Accounts
Only photographers are required to create accounts. Climbers and other visitors may browse and download watermarked photos without an account. By creating an account, you agree to provide accurate information and maintain the security of your credentials.
3. Photographer Obligations
By uploading photos to the Platform, photographers warrant that:
- They are the copyright owner of all uploaded photos.
- They have not signed conflicting agreements with event organizers that would prevent display on this Platform.
- They grant the Platform a non-exclusive, royalty-free license to display, thumbnail, watermark, and distribute their photos for the purpose of operating the gallery.
- They retain full ownership of their original works.
4. Photo Downloads
The Platform provides free access to full-resolution (HD) photos uploaded by photographers. A tipping prompt is displayed before download to encourage users to support photographers, but tipping is entirely voluntary. Downloaded photos are for personal, non-commercial use only unless the photographer grants explicit permission for other uses.
5. Tips and Transactions
The Platform is not a party to any transaction between photographers and users. All tips and donations flow directly between the two parties via their chosen payment methods (GCash, Ko-fi, etc.) and happen entirely off-platform. The Platform does not process, hold, or take commission on any payments.
6. User Responsibilities
Users who download photos assume responsibility for obtaining any necessary permissions for commercial use. Photos downloaded from the Platform are for personal, non-commercial use only unless the photographer grants explicit permission for other uses.
7. Content Removal
If you believe a photo on the Platform infringes your rights or you wish to have your likeness removed, please contact us at jamescasia99@gmail.com. We will process removal requests promptly. Photographers may also remove their own content at any time through their dashboard.
8. Future Changes
The Platform reserves the right to introduce fees, commissions, subscription plans, or advertisements with 30 days' advance notice to all registered users. Continued use of the Platform after such changes constitutes acceptance of the updated terms.
9. Limitation of Liability
The Platform is provided “as is” without warranties of any kind. To the maximum extent permitted by law, the Platform and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
